Welcome to Lumate Tenant Insight System (“Lumate TIS”, “we”, “us”, or “our”). These Terms govern your access to and use of our website, dashboards, reports, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.
1. Beta Service; No Legal Advice
During this beta, Lumate TIS is provided on an “as is” and “as available” basis for evaluation and early production use. We may add, change, or remove features at any time.
2. FCRA & Fair Housing Disclosures (Important)
We are not a Consumer Reporting Agency (CRA) as defined by the Fair Credit Reporting Act (FCRA), and the reports generated by Lumate TIS are not “consumer reports.”
- Reports are provided for informational and screening-support purposes only and are generated using data you provide or authorize.
- Do not use a TIS report as the sole basis for any adverse housing decision. If you choose to rely on information to deny, increase deposit/rent, or otherwise take adverse action, you are responsible for complying with applicable laws (including FCRA adverse action notice procedures and state/local rental screening laws).
- Nothing in the Services constitutes legal advice. Please consult an attorney for legal questions about tenant screening.
- Credit scores shown in reports are self-reported by users and are not verified or sourced from a consumer reporting agency.
3. Eligibility & Accounts
- You represent that you are at least 18 and have authority to use the Services.
- You are responsible for maintaining the confidentiality of your account and for all activities under it.
4. Acceptable Use
- Do not misuse the Services, attempt to access data you do not own, or reverse-engineer systems.
- Do not use the Services in a discriminatory manner in violation of fair housing laws or other applicable regulations.
5. Payments & Refunds
Payments are processed by Stripe. By paying, you agree to Stripe’s terms. Unless required by law, payments are generally non-refundable except for duplicate charges or failure to generate a report due to technical issues. To request a review of a charge, contact us at support@lumateinc.com within 7 days.
6. Intellectual Property
All trademarks, logos, and content in the Services remain the property of their respective owners. You receive a limited, non-exclusive, revocable license to use the Services for their intended purpose.
7. Privacy
Your use is also governed by our Privacy Policy, which explains how we collect and use data (including storage in Firebase and payments via Stripe).
8. Disclaimers; Limitation of Liability
To the fullest extent permitted by law, Lumate TIS disclaims all warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for claims relating to the Services will not exceed the amounts paid by you in the 3 months prior to the claim.
9. Changes to Terms
We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance.
10. Governing Law
These Terms will be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
